These Terms and Conditions ("Terms") govern your access to and use of the website operated by AestheTeQs (also referred to as "we", "us", or "our") at aestheteqs.com and related online properties (collectively, the "Website"), and they describe the general framework for how we offer professional software and technology services.

By accessing or using the Website, requesting information, submitting a contact form, booking a meeting through our scheduling tools, or engaging us for services, you agree to these Terms. If you do not agree, please do not use the Website or our services.

Specific engagements (for example custom development, consulting retainers, or managed services) are typically governed by a separate written agreement such as a statement of work, master services agreement, or proposal accepted by both parties ("Project Agreement"). If there is a conflict between these Terms and a signed Project Agreement, the Project Agreement prevails for that engagement.

AestheTeQs provides professional technology services, which may include (without limitation) web and application development, cloud integration, DevOps and automation, UI/UX design, and solutions involving artificial intelligence and machine learning. The exact scope, deliverables, timelines, fees, and acceptance criteria for any paid work are defined only in a Project Agreement or written order signed or expressly accepted by both parties.

Information on the Website (including case studies, descriptions, and marketing content) is for general illustration. It does not constitute a binding offer unless confirmed in writing.

You represent that you have the legal capacity to agree to these Terms. If you use the Website or procure services on behalf of an organization, you represent that you are authorized to bind that organization.

You agree not to:

• Use the Website in violation of applicable laws or regulations
• Attempt to gain unauthorized access to our systems, networks, or data
• Introduce malware, excessive automated traffic, or other harmful or disruptive activity
• Scrape, harvest, or copy Website content or user data in bulk without our prior written consent
• Misrepresent your identity or affiliation, or use our brand in a misleading way

We may suspend or restrict access to the Website or to non-contractual communications where we reasonably believe there is abuse, fraud, security risk, or a breach of these Terms.

Unless otherwise agreed in a Project Agreement, AestheTeQs retains all rights, title, and interest in and to its pre-existing materials, tools, frameworks, internal libraries, methodologies, documentation templates, and general know-how ("AestheTeQs IP").

Upon full payment and subject to the Project Agreement, client-specific deliverables agreed in writing may be assigned or licensed to you as specified in that agreement. Open-source and third-party components may be used where appropriate; you agree to comply with the applicable licenses.

You may not remove proprietary notices from deliverables except as permitted in writing. You grant us a limited licence to use your name, trademarks, and project descriptions for reasonable marketing purposes (for example portfolio entries) unless you opt out in writing before or as part of your Project Agreement.

The Website may integrate or link to third-party services (for example scheduling, maps, analytics, messaging, or AI-assisted chat). Those services are governed by their own terms and privacy policies. We do not control and are not responsible for third-party content or availability.

Personal data you submit through the Website (such as via contact forms or meeting booking) is processed in line with our practices described on the Website and any applicable Project Agreement. You are responsible for the accuracy of information you provide.

The Website and any information on it are provided on an "as is" and "as available" basis to the fullest extent permitted by law. We disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are not legally permitted.

We do not warrant that the Website will be uninterrupted, error-free, or free of harmful components. You use the Website at your own risk.

To the fullest extent permitted by applicable law in the Islamic Republic of Pakistan, neither AestheTeQs nor its directors, employees, or contractors shall be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities, arising out of or related to your use of the Website or these Terms, except where liability cannot be excluded by law.

For claims arising solely from use of the Website (and not from a signed Project Agreement), our aggregate liability shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim for services directly linked to that claim, or (b) if no such payments exist, PKR 5,000.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be limited under applicable law.

You agree to indemnify and hold harmless AestheTeQs and its personnel from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Website, your violation of these Terms, or your infringement of third-party rights, except to the extent caused by our wilful misconduct.

Fees, invoicing, currency, taxes (including applicable Pakistan withholding or sales taxes where relevant), and payment milestones are set out in the Project Agreement. Late payment may suspend work or delivery as described in that agreement.

We may update these Terms from time to time. The "Last updated" date at the top will change when we do. Continued use of the Website after changes constitutes acceptance of the revised Terms. For material changes affecting active clients, we will use reasonable efforts to provide notice where appropriate.

These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-law rules. Courts located in Lahore, Pakistan shall have exclusive jurisdiction over disputes arising from these Terms or the Website, subject to any different dispute resolution clause in a signed Project Agreement.
